1. Acceptance
By creating an account or using the HairVia mobile application, you agree to these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
HairVia is a multi-tenant salon management platform that provides:
- Appointment booking and scheduling
- Client and staff management
- Inventory tracking
- In-app messaging
- Reports and analytics
- Subscription-based feature tiers (Free, Pro, Premium)
3. Accounts & Registration
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access
- One person or legal entity per account; accounts are non-transferable
- Salon owners are responsible for their staff accounts and the data entered by their team
4. Subscription Tiers & Billing
- Free tier: Core salon management features, single branch, limited staff
- Pro tier (KES 2,999/month): Manual marketing, in-app messaging, advanced reports
- Premium tier (KES 4,999/month): Marketing automation, automated surveys, multiple branches, unlimited staff
- New accounts receive a trial period (default 90 days of Premium access)
- Billing is processed through Stripe. We do not store payment card details
- Failed payments enter a 7-day grace period before downgrade to Free tier
- You may cancel your subscription at any time; access continues until the end of the billing period
- Refunds are handled on a case-by-case basis; contact support@hairviaapp.com
5. Acceptable Use
You agree NOT to:
- Use the App for any unlawful purpose
- Upload malicious content, viruses, or harmful code
- Attempt to access other tenants' data or bypass security controls
- Scrape, reverse-engineer, or decompile the App
- Use the App to send spam or unsolicited communications
- Misrepresent your identity or impersonate others
- Exceed reasonable usage limits that degrade service for other users
6. Data Ownership
- Your data is yours. Salon owners retain ownership of all business data (clients, bookings, staff, services) entered into the platform
- You grant HairVia a limited license to process your data solely to provide the service
- Upon account deletion, your data will be removed per our Privacy Policy retention schedule
- HairVia may use anonymized, aggregated data for platform improvement and analytics
7. Intellectual Property
- The HairVia app, brand, design, and code are the intellectual property of HairVia LLC
- You may not copy, modify, or distribute any part of the App
- User-generated content (reviews, feedback, messages) remains the property of the creator
8. Service Availability
- We aim for high availability but do not guarantee 100% uptime
- Scheduled maintenance will be communicated in advance when possible
- We are not liable for service interruptions caused by third-party providers (Supabase, Stripe, Brevo, Expo)
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- HairVia is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim
- We are not responsible for data loss caused by your actions (e.g., accidental deletion)
10. Indemnification
You agree to indemnify and hold HairVia LLC harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11. Termination
- You may delete your account at any time via the App or by contacting support
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your right to use the App ceases immediately
- Data deletion follows the Privacy Policy retention schedule
12. Dispute Resolution
- Disputes will first be attempted to be resolved through good-faith negotiation
- If unresolved, disputes will be subject to mediation in Nairobi, Kenya
- These Terms are governed by the laws of the Republic of Kenya, except where mandatory US federal law applies
- Nothing in these Terms limits your rights under the Kenya Data Protection Act 2019
